Terms and Conditions

Please read the following Terms and Conditions relating to your subscription carefully

By subscribing to BUST Magazine ("Magazine") published by BUST Inc. ("BUST"), you agree to the terms and conditions set forth in this Agreement (this "Agreement") and BUST's privacy policy (https://bust.com/info/privacy-policy.html). If you do not agree with these Terms and Conditions or BUST's privacy policy, do not subscribe to the Magazine.

The personal information that you have provided to us, for the purposes set forth below, will be collected and maintained on servers in the United States, and will be shared with BUST.

We reserve the right, in our sole discretion, to change, modify, add or remove provisions of this Agreement at any time. You should check this Agreement periodically for changes. If you do not agree to this Agreement or any modifications made to it, you should not subscribe to the Magazine or, if you have already purchased a subscription, you should cancel your subscription with us.

Payment  and Fees
As a subscriber to our Magazine, you agree to pay, using a valid debit or credit card (or other form of payment) which we may accept from time to time. The cost of subscriptions to the Magazine will include the cost of shipping and handling.

All credit cards will be debited in US Dollars. All other currencies will be converted into US Dollars. Your bank or building society may apply its exchange rate to convert the US Dollars to your local currency and/or charge an additional fee for the transaction.

It is the Subscriber's responsibility to verify that the information submitted is accurate to insure proper billing and continuity of services. BUST may use Merchant Updater Services to receive updated billing information from participating providers.

Subscription/Payment Data
For purposes of your payment, you agree to provide true, accurate and complete information as required by the subscription and purchase process ("Subscription/Payment Data"), including your legal name, address, email address and applicable billing information (e.g., credit card number, expiration date and security code), and to allow us to share your Subscription/Payment Data with third parties for the purpose of verifying the information you provide and billing your credit card or otherwise charging your account.

If you provide any information that is untrue, inaccurate, or incomplete, or we have reasonable grounds to suspect that such is the case, we reserve the right to suspend or terminate your order.

Automatic Renewal of Subscription
As a courtesy and not as an obligation (contractual or otherwise), fifteen (15) and thirty (30) days prior to the expiration of Suscriber's subscription, BUST  will automatically renew Subscriber's subscription by charging the applicable cost for the non-promotional rate to Subscriber's current method of payment on file. The Initial Term shall begin upon commencement of the Services to User, and after the Initial Term, this Agreement shall continue for successive periods (or renewal period) of equal length as the Initial Term or such other Term and price that shall be set forth in a notice to the customer at least 24 hours prior to the commencement of such successive period or renewal period. Additionally after the initial Term, you acknowledge, agree and authorize us to automatically bill and/or charge on your credit card for successive or renewal periods, unless terminated or cancelled by either party as provided in this section. The Initial Term and all successive renewal periods shall be referred to, collectively, as the "Term".

Validation
All orders are subject to validation checks and authorization by your payment card issuer. If we do not accept your order and your credit/debit card has already been debited, we will notify you and refund your card in full immediately.

If you are under 18 you must ask permission from a parent or guardian before purchasing.

Receipt of Subscription
BUST is published 6 times a year. Depending on when you place your subscription order, receipt of your first issue may take anywhere from 4-8 weeks. If you do not receive it within this time, please contact Customer Service at: subscriptions@bust.com

Changes to your Subscription/Payment Data
You are responsible for keeping your Subscription data up to date and accurate. If there are any changes to your Subscription Data, such as a change of name or address or email, you must contact Customer Service at subscriptions@bust.com and put "SUBSCRIPTION CHANGE" in the subject line and provide your updated info in the body of your message.

Cancellation and Refunds
Either you or BUST Inc. may terminate or cancel your subscription at anytime and receive a refund for the unused-portion of your order. You can cancel your subscription by contacting Customer Services at subscriptions@bust.com or by such other means as we may provide from time to time. We will attempt to process all cancellation requests within 24 hours after we receive your request. Refunds of your subscription will be made after deducting the full single issue cost for each magazine you have been sent, including shipping. We also reserve the right to collect any outstanding fees, surcharges, or costs incurred before your cancellation takes effect.

Credit Card Refunds: please note that all credit card refunds will be issued in US Dollars. Your credit card company or bank will convert the amount into your local currency and may charge an additional fee for completing the transaction.

If you cancel your subscription, you understand and agree that the cancellation or termination of your subscription is your sole right and remedy with respect to any dispute with us including, without limitation, any dispute related to, or arising out of: (i) any terms of this Agreement or our enforcement or application of this Agreement; (ii) any practice or policy of BUST Inc, including our Privacy Policy (https://bust.com/info/privacy-policy/), (iii) our enforcement or application of these policies; or (iv) the amount or types of our fees or charges, surcharges, applicable taxes, or billing methods, or any change to our fees or charges, applicable taxes, or billing methods.

We are committed to protecting your privacy and security. For more information, you should review our Privacy Policy (https://bust.com/info/privacy-policy.html), which is incorporated into this Agreement by this reference.

DISCLAIMER OF WARRANTIES

THE MAGAZINE AND YOUR SUBSCRIPTION TO IT IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. ADDITIONALLY, THERE ARE NO WARRANTIES AS TO THE RESULTS OBTAINED FROM THE USE OF THE SITE.
LIMITATION OF LIABILITY

IN NO EVENT SHALL BUST INC, ITS AFFILIATE DIRECTORS, OFFICERS OR EMPLOYEES BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM THE SERVICES OR PRODUCTS PROVIDED HEREUNDER, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION.

Your exclusive remedy for any claim shall be limited to the fees paid by you during which the event giving rise to the claim occurred or the cost of your subscription to the magazine, whichever is greater. In no event shall our liability to you exceed the amount paid by you. The limitations, exclusions and disclaimers set for above shall apply and be enforceable to the maximum extent allowed by applicable law, even if any remedy fails its essential purpose.
